Professor Catherine Brown and Abbey Kind, JD'20 have published an article in Personal Tax and Estate Planning.
"Family Corporations and Investment Income: Winners and Losers in the Taxation of Family Wealth" highlights potential tax consequences to family wealth held in CCPCs maintaining investment portfolios, as a result of changes to the Income Tax Act (the “Act”). Through examining two potential CCPC structures and detailing the resulting tax implications, the authors identify the winners and losers of such changes. The CCPC structures considered include one in which professional fees are generated together with an investment income intended for retirement as well as one with professional fees, a substantial investment income and five or more employees.
